A person may be able to save their house from a sheriff’s sale by filing a chapter 13 case, prior to the sale. There are very few exceptions that will allow someone to save their house after the sale. The bankruptcy code offers two options for saving a house. The debtor can save his house, after the filing, if the mortgage company offers the debtor a loan modification. Typically, a loan modification either incorporates the arrears into the loan balance, or has HUD payoff the arrears. In the event of the latter, HUD will be provide a second mortgage that must be paid, in a lump sum, after a sale or refinancing.  The other option requires the debtor to pay back the total amount he is behind with the mortgage, over a sixty month plan.
