The court requires from the debtor the same documents, whether you are filing under Chapter 7 or Chapter 13. A debtor is required to provide the attorney with the following documentation and information:
- Any and all pay stubs and proof of income for both spouses and any others residing in the residence, for approximately six months prior to the filing. The first pay stub due is the first pay stub received on the sixth month before the month of the filing. The last pay stub is the last pay stub received prior to the filing. Therefore, if an individual files on February 10, 2008, you must provide all pay stubs from August 1, 2007, through and including the last pay stub received prior to the filing. Please note that a computer printout of all income and deductions is acceptable.
- The debtor(s) federal income tax returns, representing the four years prior to the filing;
- A copy of any Support or Alimony Court Order;
- If you own real estate, an Appraisal, Brokers’ Opinion, or Comparative Market Analysis, which reflects the fair market value of your real estate;
- Certificate of Credit Counseling. (explained above);
- Credit report;
- Receipts providing proof of living expenses, such as food, clothing and utilities;
- Photo drivers’ license and social security card (possible to provide alternative document to social security card.);
- Most recent bills from all creditors, including mortgage and auto financing statements;
- A list of any and all assets and the value of each. This includes any and all personal and real property, including, but not limited to the following: furniture, household goods, collectables, clothing, furs, jewelry, stocks, bonds, autos, interest in companies, investments, bank accounts, real estate, any right to a claim against someone for personal injury or money;
- Make, model, year, miles and condition of each auto;
- Additional information, including but not limited to the following: law suit information, any prior bankruptcy filings, any recent large payments to creditors, business documents, recent gifts to another, your intention as to whether you are keeping or surrendering your house and auto;
- If a corporation or business is involved, the court requires the following documents and records: six months of bank statements, six months of profit and loss statements; insurance documents; last four years of tax returns; list of Inventories; list of any shareholder and/or officer of corporation; list of individuals who handle accounting records; list of all equipment owned by corporation; date inventory purchased; from whom purchased; amount paid; current value; amount owed on equipment; all financial records, including loans outstanding, credit card bills, bank statements, accounts payable, accounts receivable etc
